Terms and Conditions
DEFINITIONS
- a) "The Act" - The Copyright Act, 1957.
- b) "Licence Fee" - Fees payable for the interest in the rights granted for the limited purpose.
- c) "Licence Period" - A limited period stated on the licence copy authorizing the licensee to use sound recordings for communication to the public.
- d) "Communication of Sound Recordings to Public" - Making any sound recording work or performance available for the public to hear or enjoy directly or by any means of diffusion, whether simultaneously or at individual times and places.
- e) "Background Licence" - Applicable if you are playing sound recordings at your Premises, excluding featured events.
- f) "Event Licence" - Applicable for playing sound recordings during a particular event/show/function at your premises.
- g) "List of Music Labels" - A list of Music Labels/Companies who have granted exclusive rights of their sound recording Repertoire to PPL with specific exclusions/restrictions.
LICENCE
- a) Subject to this Licence and payment of the Licence Fee, PPL grants the Licensee a non-exclusive, limited licence under Section 30 of the Act to communicate sound recordings to the public at the licensed premises during the Licence Period.
- b) Licence expires automatically after the Licence Period ends, and the Licensee shall not communicate sound recordings after its expiry.
- c) PPL reserves the right to revoke/cancel the licence if the Licensee breaches the terms of this Licence.
- d) In case of renewal, the start date will follow PPL's records, and the Licensee shall not use PPL sound recordings without a valid licence.
- e) PPL reserves the right to modify/alter the terms of the licence without notice.
- f) A Background Licence is not valid for Events such as shows, functions, or DJ parties, for which a separate Event Licence must be obtained.
- g) Licence fees are based on the Licensee's declarations. Concealment or incorrect declarations will be treated as infringement and damages will be recovered.
- h) Non-compliant Licensees seeking to regularize past infringements shall pay damages at PPL's discretion.
- i) PPL reserves the right to inspect licensed premises during and after the Licence Period for unauthorized sound recording usage.
- j) The Licensee agrees not to permit any unauthorized person to use PPL sound recordings outside the terms of this Licence.
- k) This Licence is non-transferable and cannot be sub-licensed. No third parties have rights under this Licence.
